Digital Image Licensing

What is digital image licensing?

I sell a license for the digital usage of my images. Therefore you have to purchase a license that gives you the right to use my image. The process to follow is called digital image licensing and the principle is the same as licensing for software. You can read up below on the details of a rights-managed license.

I will need the following information 

  • Usage: Do you require the photo for commercial or personal use.
  • Size: Specify photo size in pixels and dpi (pixels per inch).
  • Period: How long do you intend to use the image.
  • Media: In what media do you intend to use the image.
  • Territory: In which country do you intend to use the image.

Rights Managed License

Below is the terms and conditions for the rights managed license that will be issued  for the usage of his photos. 
  • Nick Joubert Photography offers photographs under a rights managed license. A Rights managed license is limited to the specific use of digital photographs in terms of media, period and territory as specified in the cost estimate and/or invoice. The license will also be non-exclusive, meaning you will not have exclusive rights to the image. Nick Joubert Photography can license the same photographs to other clients for the same media, time period and territory as specified in the cost estimate and/or invoice.
  • The rights permitted are non-transferable and non-sublicensable. Therefore one cannot transfer or sublicense them to a third party.
  • All of the licensed photographs are owned by Nick Joubert Photography. All of the other rights not permitted in this agreement are retained by Nick Joubert Photography for the use of the photographs in any manner, at any time and in any part of the world for commercial or personal use, which includes amongst others, self-promotional purposes, competition entry and selling of digital or printed copies of the photographs to other clients. You may not assert any right to revenue from any third party, which includes amongst others, a collecting society, social media website, content sharing platform in respect of printing, photocopying, digital copying, sharing, distribution or any other secondary uses of the licensed photographs.
  • Nick Joubert Photography will not be liable to you or any other person or entity for any costs, damages or losses that emerge due to this agreement.
  • You agree to put the necessary security measures in places to protect the photographs from unauthorized use by third parties. One digital copy of a photograph is allowed for back-up purposes. No other copies, either digital or print, of the photographs are allowed according to this license agreement.
  • The licensing rights are only permitted to the person or company whose name and billing address is specified in the cost estimate or invoice.
